What is FSSAI and the FSSAI License

FSSAI stands for the Food Safety and Standards Authority of India, the central body set up under the Food Safety and Standards Act, 2006 to regulate the food industry in India. The FSSAI License is a 14 digit number issued to a food business operator. It must be printed on food packaging and displayed at the business premises. For cloud kitchens, the number is also mandatory on every food delivery package.

Operating without it is a criminal offence with a penalty up to ,s lakh in fines and imprisonment, plus closure of the business and seizure of stock. In Uttar Pradesh, the licence is issued by the Food Safety Commissioner, Department of Food Safety and Drug Administration, Government of UP, with the state office in Lucknow at 9 Jagat Narain Road.

Field inspections happen through district level Designated Officers.

 

FSSAI 2026 Amendment - What Changed from April 1, 2026

The Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026 was notified through Gazette Notification No. RCD-01002/1/2021-Regulatory-FSSAI-Part(l) dated 10 March 2026, with the implementing order issued on 13 March 2026. The reforms were recommended by the NITI Aayog High Level Committee on Non-Financial Regulatory Reforms.

Turnover thresholds revised.

Basic Registration limit raised from ₹12 lakh to ₹1.5 crore. State Licence band now ₹1.5 crore to ₹50 crore. Central Licence trigger raised from ₹20 crore to ₹50 crore.

Perpetual validity introduced.

From 10 March 2026, every FSSAI licence is valid indefinitely until suspended, cancelled or The old 1 to 5 year terms with mandatory renewal are gone. Annual fee is still required.

Who Needs FSSAI License in UP

If you handle food at any stage from manufacturing to the customer, you need an FSSAI registration or licence. The Act covers restaurants, cafes, dhabas and food courts; cloud kitchens, dark kitchens and ghost kitchens running multiple delivery brands; online food delivery operations; sweet shops, bakeries and namkeen sellers; dairy units, milk distributors, paneer makers and ghee producers; food manufacturers and processors; spices, masala and pickle units; food packagers; FMCG distributors and retailers; hotels, banquet halls and caterers; tiffin services and home based food businesses; food trucks and street food stalls; grocery stores and kirana shops selling packaged food; mineral water plants; food importers and exporters; cold storage operators; canteens at schools, colleges and hospitals; and slaughterhouses, meat shops and fish sellers.

Street vendors already registered under the Street Vendors Act, 2014 are now treated as deemed registered with FSSAI under the 2026 amendment.

Basic, State and Central (Revised April 2026)

FSSAI Basic Registration (up to ,1.s Crore)

For food businesses with annual turnover up to ,1.s crore. The old limit was ‘{12 lakh, so a much wider set of businesses now fall under this lighter category. It covers petty food vendors, hawkers, home kitchens, tiffin services, small dhabas, single owner sweet shops, food trucks, food carts, small bakeries, home bakers, single brand cloud kitchens in their starting phase and

small retailers. Filed in Form A. Petty FBOs now get the certificate instantly on payment of the

‘HOOfee through FoSCoS, without pre-inspection.

FSSAI State License ("1.5 Crore to"50 Crore)

For food businesses with annual turnover between “1.5 crore and “50 crore. Covers most restaurants, hotels, mid sized manufacturers, dairy units, scaled up cloud kitchens running multiple delivery brands from one location, food processors, wholesalers, transporters, regional restaurant chains, cold storage operators, food distributors and large catering services. Filed in Form B with detailed documentation including business registration, premises layout, food category list and a basic food safety plan.

FSSAI Central License (above "50 Crore)

For large food businesses with annual turnover above “50 crore, businesses operating across more than one state, food businesses at central agency premises like seaports, airports and railways, multi-city cloud kitchen chains, and importers and exporters of food products regardless of turnover. Pan India food chains, dairy and meat processing units, and 100 percent Export Oriented Units also fall under Central. Filed in Form B with additional documentation including manufacturing layouts, food safety management system, water test reports and equipment specifications.

Under the 2026 amendment, FSSAI licences are perpetually valid, but the annual fee is still mandatory. Non-payment leads to automatic suspension.

The State Licence fee varies within the slab depending on business type and capacity. Manufacturing units, hotels and large processors pay closer to the upper end. Retailers, small caterers and single-location cloud kitchens pay closer to the lower end. You can pay the annual fee for multiple years upfront to avoid year-on-year tracking.

This is only the government fee. The total cost also includes consultancy, business registration if you do not yet have GST or Shop and Establishment in place, food safety plan preparation for State and Central applications, and incidental expenses.

 

How to Apply for FSSAI License Online via FoSCoS

The FSSAI application in UP is filed online through the FoSCoS portal (Food Safety Compliance System), the official portal that replaced the older FLRS system.

We start with a document review to identify your category under the 2026 thresholds and what documents you need. If your firm does not yet have GST or Shop and Establishment registration, we set those up first. We then create your FoSCoS account and select the correct application type

Form A for Basic Registration, Form B for State and Central Licence. We fill the form with your business details, food categories, premises information and equipment list, and upload supporting documents. The annual fee is paid online during the application, with the option to pay multiple years upfront.

After submission, the system generates a 17 digit reference number for tracking. For Petty FBOs, the certificate is instant. For State and Central applications, a Designated Officer visits the premises for an inspection – now risk-based, so frequency depends on your food category, compliance history and risk score. Once cleared, the FSSAI Certificate is issued in Form C and made available on FoSCoS. The certificate is now valid perpetually subject to timely annual fee payment and ongoing compliance.

Documents Required for FSSAI Registration

Perpetual Validity and Annual Fee Payment

Under the 2026 amendment, the old 1 to 5 year licence terms with mandatory renewal have been removed. From 10 March 2026, every FSSAI licence is perpetually valid until suspended, cancelled or surrendered.

But perpetual validity does not mean hands-off. The annual fee must be paid on time – non-payment triggers automatic suspension. You can pay multiple years upfront. Food Safety Compliance Return (FSCR) must be filed by State and Central licence holders. Compliance with food safety standards under Schedule 4 must be maintained. Risk-based inspections continue throughout the life of the licence.

Existing licences issued before 1 April 2026 also benefit from perpetual validity automatically. No conversion application needed.

Risk-Based Inspections Under the 2026 Reforms

Inspection frequency now depends on food category risk (high-risk categories like dairy, meat, infant nutrition and packaged drinking water are inspected more often), past compliance history, third-party audit performance, surveillance inputs from sample testing and complaints, and business size and impact . Compliant low-risk businesses face fewer disruptions. High-risk and non-compliant businesses face more frequent inspections.

Beyond the legal penalty, no e-commerce platform like Zomato, Swiggy, Amazon, Flipkart, BigBasket, Magicpin or ONDC lists a food seller without a valid FSSAI number. No corporate buyer, hotel chain, hospital or institutional client buys from an unlicensed supplier.

Why FSSAI Applications Get Rejected

The biggest reason for rejection is wrong category selection, especially after the 2026 threshold revision - many applicants are still working off the old '{12 lakh and '{20 crore numbers. The second is wrongly mapped food category list, where the FSSAI portal categories do not match the business activity. This is particularly common with cloud kitchens running multiple cuisines and brands from one kitchen. Other common mistakes include premises address mismatch, layout plan missing or wrong format, no NOC where required, missing water test report for manufacturing units, generic food safety plan, GST registration in another state, name mismatch across PAN, Aadhaar, GST and bank documents, photographs not matching the rented premises, equipment list not matching what is installed, and unpaid annual fee on existing licences leading to suspension.

FSSAI License for Cloud Kitchens in Lucknow and UP

 

Cloud kitchens, also called dark kitchens or ghost kitchens, are the fastest growing segment of the Indian food industry. UP cities like Lucknow, Noida, Ghaziabad, Kanpur and Varanasi are seeing a sharp rise in delivery-only kitchens running on Zomato, Swiggy, Magicpin, EatSure and ONDC. The FSSAI rules apply differently based on how your cloud kitchen is structured.

A single brand cloud kitchen with annual turnover up to ‘{1.5 crore now qualifies for Basic Registration with instant approval through FoSCoS – a significant simplification from the old ‘{12 lakh threshold that ruled out most operators. This is the fastest legal route for new entrants.

A multi-brand cloud kitchen running several delivery labels from one address, where combined turnover crosses ‘{1.5 crore, needs a State Licence. Each delivery brand operating from the same

kitchen is treated as part of the parent FBO, and the FSSAI number must appear on every order, every package label and every digital listing on Zomato, Swiggy and similar platforms.

A multi-city cloud kitchen chain operating across more than one state needs a Central Licence regardless of turnover, with detailed kitchen layout, food safety management system and category-wise documentation for every brand.

Most independent restaurants, cafes and dhabas in Lucknow, Noida and other UP cities with turnover under ₹1.5 crore now fall under Basic Registration. Restaurants above ₹1.5 crore need a State Licence. Online listing on Zomato, Swiggy and Magicpin needs a valid FSSAI number.

FSSAI License for Sweet Shops, Bakeries and Namkeen Manufacturers

Single shop sellers and small bakeries up to ₹1.5 crore qualify for Basic Registration. Manufacturers beyond that need State Licence with layout plan, equipment list and food safety documentation. Big in Lucknow, Kanpur, Varanasi, Agra, Bareilly and Aligarh.

FSSAI License for Dairy Units and Milk Businesses

Dairy is treated as a higher-risk category for inspection. Small dairy units up to ₹1.5 crore can operate under Basic Registration. Larger units need State Licence with detailed water test reports, equipment specifications and food safety plans.

FSSAI License for Caterers, Tiffin Services and Home Kitchens

Caterers, tiffin services and home kitchens up to ₹1.5 crore qualify for Basic Registration with instant approval. Larger catering operations and banquet halls need State Licence. Home bakers, cake businesses and packaged food sellers under ₹1.5 crore qualify for the same instant route.

FSSAI License for Food Manufacturers and FMCG Brands

Manufacturers of packaged spices, pickles, chutneys, papads, snacks, beverages and confectionery between ₹1.5 crore and ₹50 crore need a State Licence. Above ₹50 crore, Central Licence applies.

FSSAI License for Importers, Exporters and Specialised Categories

Food importers and exporters always need a Central Licence regardless of turnover, plus an Import Export Code (IEC). Mineral water and packaged drinking water plants need a Central Licence along with BIS Certification. Food trucks and food carts are now explicitly classified as Petty FBOs, qualifying for Basic Registration with the ₹100 fee and instant approval.

What is FSSAI License?

Yes. If you run several delivery brands from the same kitchen address, one FSSAI Licence in the parent FBO name covers all of them. Each brand listing on Zomato, Swiggy or other platforms must display the same FSSAI number, and the number must appear on every delivery package label.

No. Zomato, Swiggy, Magicpin, EatSure, ONDC, Amazon, Flipkart and BigBasket do not list food sellers without a valid FSSAI registration or licence number. Onboarding will be blocked until the number is provided.

Annual fee is ₹100 for Basic Registration, ₹2,000 to ₹5,000 for State Licence, and ₹7,500 for Central Licence. The licence is perpetually valid but annual fee must be paid on time. Multiple years can be paid upfront.

The annual fee has not changed. What changed is the system – the licence is now perpetual instead of being issued for a 1 to 5 year term, so there is no separate renewal fee.

For Basic Registration: photo ID, address proof, passport size photo and business activity declaration. For State and Central: also GST registration, Shop and Establishment, business incorporation, layout plan, equipment list, food category list, food safety plan and additional category-specific documents.

Basic Registration is now instant for Petty FBOs after fee payment, including for new cloud kitchens. State Licence takes 30 to 45 working days including inspection. Central Licence takes 45 to 60 working days.
